Unanimous action on the proposal came during the board’s July meeting Monday evening (July 11th).
If the settlement agreement pertaining to compensation is approved by the boards of Fabius and Park townships, it would complete Lockport Township’s withdrawal from a joint township fire department interlocal agreement adopted by the three townships in 2007.
Township Supervisor Ray Signorello outlined the agreement’s payment schedule and said that both Fabius and Park townships would pay Lockport Township $64,000 – a total of $128,000 – in the first year. In the second and third years, each of the townships would pay $50,000 per year – a total of $100,000 per year or $200,000 over the two-year period.
Signorello said that – with the initial payments totaling $128,000 – Lockport Township will sign over the real property. Regarding personal property, he said, “We will hang on to a chattel mortgage which will protect us to a certain extent if one of them happens not to come up with the money.”
Signorello said the agreement was drawn up by John Lohrstorfer, the attorney for Fabius and Park townships, and then sent to Philip Schaefer, Lockport Township’s attorney for fire department issues. According to Signorello, Schaefer suggested a few changes, “more or less just wording.” (Ray_Signorello audio clip – 1:32)
In a related action, the board voted unanimously to authorize Signorello and Township Clerk Wayne Timm to sign documents related to the settlement agreement, if they have been reviewed and approved by Schaefer.
Regarding the proposed agreement, Signorello said, “I think this is a pretty good agreement. It gives us some protection. We’re not just out there with no protection on the cash.”
The proposed buyout agreement reflects the end of a 51-year partnership through which the three townships jointly operated the LFP Fire Department. The arrangement fell apart in 2008 in the midst of controversy related to construction of a new fire station on Broadway Road and resulted in formation of the two-township Fabius-Park Fire Department (FPFD).
